1. GENERAL INFORMATION

1.1 Identification of the Owner

1.2 Scope

These Terms and Conditions (hereinafter "Terms") govern the access and use of the PrimeFlow Core and PrimeFlow Pearl mobile applications (hereinafter "the Application" or "PrimeFlow"), as well as the services offered through them.

1.3 Acceptance

Access, download and/or use of the Application implies full and unreserved acceptance of these Terms. If you do not agree with any of the conditions set out herein, please do not use the Application.

2. SERVICE DESCRIPTION

2.1 What is PrimeFlow?

PrimeFlow is a mobile application for pelvic floor training through guided Kegel exercises. It is available in two versions:

• PrimeFlow Core: Designed exclusively for men
• PrimeFlow Pearl: Designed exclusively for women

2.2 Features

The Application offers:

• Personalised exercise programmes based on individual goals
• Guided sessions with visual and audio cues
• Progress tracking and analytics
• Achievement and gamification system
• Educational content on pelvic floor health

2.3 Medical Disclaimer

THE APPLICATION DOES NOT CONSTITUTE A MEDICAL DEVICE NOR DOES IT PROVIDE DIAGNOSIS, TREATMENT OR MEDICAL ADVICE.

PrimeFlow is a wellness and exercise tool. If you suffer from any medical condition related to the pelvic floor, consult a healthcare professional before using the Application.

3. REGISTRATION AND USER ACCOUNT

3.1 Requirements

To use the Application, you must:

• Be at least 18 years old
• Provide truthful and up-to-date information
• Create a personal account with email and password
• Accept these Terms and the Privacy Policy

3.2 Account Responsibility

The user is responsible for:

• Maintaining the confidentiality of their credentials
• All activity that occurs under their account
• Immediately notifying PrimeFlow of any unauthorised use

4. SUBSCRIPTION MODEL

4.1 Free Version

The free version includes:

• Access to 3 basic exercises (Level 1)
• Maximum of 2 Progression Points (PP) per day
• Basic progress display

4.2 Premium Subscription

The Premium subscription unlocks:

• Full library of 14 exercises across all levels
• Unlimited Progression Points
• Detailed analytics and charts
• Complete achievement system
• All educational guides

4.3 Prices

Prices are shown inclusive of applicable taxes and may vary by region. The final price displayed in the App Store or Google Play at the time of purchase will always apply.

4.4 Payment and Renewal

• Payments are processed through the App Store (Apple) or Google Play (Google)
• Subscriptions renew automatically at the end of each period
• You will be charged within 24 hours before the current period ends
• Auto-renewal may be disabled at least 24 hours before the end of the current period

4.5 Cancellation and Refunds

• You may cancel your subscription at any time through the settings of the App Store or Google Play
• After cancellation, you will retain Premium access until the end of the current paid period
• Refunds are governed by the policies of Apple or Google, as applicable
• PrimeFlow Labs S.L. does not process payments or refunds directly

5. ACCEPTABLE USE

5.1 The User Agrees To

• Use the Application only for personal, non-commercial purposes
• Not reproduce, distribute or modify the Application or its content
• Not attempt to reverse-engineer, decompile or extract the source code
• Not use the Application to collect data from other users
• Not share Premium subscription credentials

5.2 Prohibited Content

Users must not upload or share content that:

• Is illegal, defamatory or offensive
• Infringes third-party intellectual property rights
• Contains malware or malicious code
• Impersonates another person or entity

6. INTELLECTUAL PROPERTY

6.1 Ownership

All intellectual and industrial property rights in the Application, including but not limited to the software, design, graphics, text, exercises, algorithms and brand, belong to PrimeFlow Labs S.L.

6.2 User Licence

The subscription or free download grants the user a licence that is:

• Personal: for individual use only
• Non-exclusive: may be granted to other users
• Non-transferable: may not be assigned to third parties
• Limited: only for the intended use of the Application
• Revocable: may be cancelled for breach

6.3 User Content

Users retain the rights to the personal data they enter into the Application (name, preferences, etc.). By using the Application, users grant PrimeFlow Labs S.L. a licence to:

• Store and process data in accordance with the Privacy Policy
• Generate anonymous, aggregated statistics
• Improve personalisation algorithms

7. DATA PROTECTION

7.1 Data Controller

PrimeFlow Labs S.L. is the data controller for personal data collected through the Application.

7.2 User Rights

In accordance with the GDPR, users have the right to:

• Access: know what data we process
• Rectification: correct inaccurate data
• Erasure: delete their data ("right to be forgotten")
• Portability: receive their data in a structured format
• Objection: object to certain processing activities
• Restriction: limit the processing in certain cases

8. LIMITATION OF LIABILITY

8.1 Disclaimer of Warranties

The Application is provided "as is" and "as available". PrimeFlow Labs S.L. does not guarantee:

• That the Application will be free of errors or interruptions
• That exercise results will be as expected
• That information will always be accurate and up to date
• Compatibility with all devices

8.2 Limitation of Damages

To the maximum extent permitted by law, PrimeFlow Labs S.L. shall not be liable for:

• Indirect, incidental or consequential damages
• Loss of data or profits
• Damages arising from use or inability to use the Application
• Health damage resulting from improper use of the exercises

8.3 Maximum Liability

The total liability of PrimeFlow Labs S.L. shall in no event exceed the amount paid by the user in the 12 months prior to the event giving rise to the claim, or EUR 50 if no payments have been made.

8.4 Exceptions

The above limitations shall not apply in cases of:

• Wilful misconduct or gross negligence
• Personal injury caused by negligence
• Breach of statutory consumer rights
• Other situations where exclusion is prohibited by law

9. UPDATES AND MODIFICATIONS

9.1 Application Updates

PrimeFlow Labs S.L. may publish updates that include bug fixes, new features, or performance improvements. Some updates may be required to continue using the Application.

9.2 Changes to the Terms

PrimeFlow Labs S.L. reserves the right to modify these Terms at any time. In the event of significant changes:

• Users will be notified via email and/or in-app notification
• 30 days' notice will be given before the changes take effect
• Continued use after the effective date constitutes acceptance
• If you disagree with the changes, you may cancel your account before the effective date

10. SUSPENSION AND TERMINATION

10.1 By the User

The user may stop using the Application at any time and request the deletion of their account via Settings > Account > Delete Account, or by email to privacy@prime-flow-app.com.

10.2 By PrimeFlow

PrimeFlow Labs S.L. may suspend or terminate a user's access in the event of:

• Breach of these Terms
• Fraudulent or abusive conduct
• Judicial or administrative order
• Prolonged inactivity (more than 24 months)

11. GENERAL PROVISIONS

11.1 Applicable Law

These Terms are governed by the laws of Spain, without prejudice to mandatory consumer protection provisions in your country of residence.

11.2 Jurisdiction

For the resolution of disputes, the courts of Barcelona (Spain) shall have jurisdiction, without prejudice to mandatory consumer forums as required by applicable law.

11.3 Severability

If any clause of these Terms is declared void, the remaining clauses shall remain valid.

11.4 Non-Waiver

Failure to enforce any provision shall not constitute a waiver of the right to enforce it in the future.

11.5 Assignment

The user may not assign their rights or obligations without prior written consent. PrimeFlow Labs S.L. may assign the contract to third parties upon prior notice.
